No More Fusebox, More Creations Coming Soon
Hello Fusebox fans,
I’m sorry I haven’t published anything new in the past few days but I’ve been subject to a rather unpleasant situation with my blog/portfolio “Fusebox Creations”. About a month ago a law firm representing Fusebox inc., a NY based design firm, contacted me claiming that I had to give up my blog’s name because supposedly it was interfering with their business and trademarked name. So after a tedious learning process in internet law and peaceful dialogue I have chosen to see this setback as an oportunity to rename my blog with a much more catchy and versatile name. It’s my personal preference to spend a few hours creating, than a few months fighting. So getting right to the point:
What’s the new name?
…it’s a surprise! Follow me on twitter to be notified!
When will the name be changed?
The official relaunch with new name, logo and redesign will be on June 21st, 2010.
Why didn’t I fight back?
Legally, Fusebox Inc. has had their mark registered for the past 2 years. Fusebox Creations was just a random name picked for my blog, no trademark whatsoever.
But there are others also using the ‘Fusebox’ word in their domain, Why am I the only one changing it?
Because my work directly competed with what Fusebox Inc. offers.
But the other companies using ‘fusebox’ in their domain also offer design and internet services…
Perhaps Fusebox Inc. found my work to be of threatening quality… But like I said, I’d rather spend a few hours creating something new than a few months fighting.
So, how should I choose a domain for my site to avoid this kind of troubles?
1. Check if the name you choose is trademarked.
2. Check if what you offer competes with what other companies with similar names/domain offer.
3. Register your mark! this is the only thing that protects you from people using similar domain names.
4. If your domain name is .com it acts under the U.S.A jurisdiction. So check trademarks in your country AND in the US.
5. Pick or mix words to form a catchy but meaningless word. Some say you shouldn’t due to SEO issues but hey, 20 years ago no one knew what ’Google’, ‘Flickr’ and ‘Facebook’ meant.
I’m sorry for any kind of inconvenience this might have caused you. I’m working very hard to make this transition as easy, positive and exciting as possible.
